SAHF Submits Comments to HUD's 30-Day Notice to Vacate for Nonpayment Proposal

SAHF submits comments to HUD's 30-day notice to vacate for nonpayment rent proposed rule. If enacted, this rule would require a 30-day notification prior to the termination of lease for nonpayment of rent in public housing and project-based rental assistance (PBRA) properties. In January 2023, SAHF's mission-driven nonprofit members became early adopters of the Biden-Harris Administration's Resident-Centered Management Challenge and committed to providing at least 30 days' notice to vacate for nonpayment of rent, among other actions within the challenge. SAHF and its members support HUD's intent to encourage housing stability and in this letter, we offer recommendations on how HUD can take actions that allow residents and owners to use these 30 days to work together to cure nonpayment of rent, recognize the economic realities that owners are facing when nonpayment of rent continues well beyond 30 days, and encourage practices and policies that more holistically address housing stability and prevent evictions.
